[1] November Court 1780; On the information of Thomas Gaskins, William Taylor, John Heath Jr. Gent. and George Ingram upon oath that John Sutton, Thomas Hurst, William Angel, Gideon Marsh, Richard Marsh, John Marsh, Isaac Peed and John Adams were aiders and abetters in a late riot in this county who shott upon Thomas Gaskins, Thomas Gaskins Junr. and John Heath Junr. ordered that the Sheriff take the above persons into immediate custody as breachers of the peace and that they give security each of them in the sum of twenty thousand pounds to appear at the next court to be held for the said county on the second Monday in December next and in the mean time be of good order and keep the peace (Northumberland County Order Book 1773-1783, 436). Atter, Daniel– (1) Montgomery County; 6 April 1779, Warrant from Walter Crockett and James McGavock to the Sheriff; “Whereas complaint has been made to us upon oath that John Henderson, Jacob Darter, Joseph Irwin, Joseph McFarland, Daniel Atter, John Stephens, Dunkin Ogullion, Philip Myer, William Black, Daniel Liberton, Daniel McKinsey, John Cox, Nathaniel Britain and Philip Lambert have entred into a conspiracy to seize the publick magaziens, and then to proceed to kill murder and lay waste this county,” warrant to apprehend them (LVA, Montgomery County Commonwealth Causes, barcode 1048926). (2) 5 May 1779, Montgomery County Court, on a prosecution against Daniel Atter for maintaining the authority of the King, “returned verdict that he is not guilty of the said Charge and that he go thence acquitted”; 7 Sept 1779, on complaint of Robert Mcfarleane against Daniel Etter for “offenses committed against the Government of this state, the prisoner being heard in his defence, the Court were of opinion that the sd. Etter be tried by a Jury according to the Act of Assembly declaring what shall be certain offences;” 9 Sept 1779, on complaint against Daniel Etter “for harbouring persons of evil fame and Enemies to this State,” he appeared in court and posted bond for his good behaviour for twelve months and one day, in the sum of £500 (Treacy, 34, 48, 155).
Atter, John- Montgomery County; 5 May 1779, prosecution against John Atter “for mainting the authority of the King” and “Levying War against the People of this State,” a jury was sworn and returned verdict that Atter should give security for his good behavior, and he acknowledged himself bound for £1000 (Treacy, 34, 132).
Austin, William- Montgomery County; 18 Aug 1780, “Tory Confession” of James Douglas, stated that “William Austin had never taken the state Oath and fain would have persuaded all his men to not take the oth” (Treacy, 293).
Ayres, James– Bedford County Court, 28 June 1779, complaint lodged against Azariah Doss & James Ayres on suspicion of a breach of an “Act for the punishment of certain offences,” the court proceeded to examination of witnesses and heard Doss & Ayres in their own defense, whereof the court found them to have committed a breach of said Act. Ayres was fined 100 pounds. The statute in view, enacted in Oct 1776, provided that individuals who “by any word, open deed, or act, advisedly and willingly maintain and defend the authority, jurisdiction, or power, to the king or parliament of Great Britain” would be subject to fine or imprisonment (Creel, Bedford County Virginia Court Orders 1774-1783, 84, with reference to Order Book 6, 234-5; Hening, Statutes at Large, vol 9, 170-71).
Ayres, John– Bedford County Court 29 Aug 1780, examination of Jno. Ayres “for high treason,” he pleaded guilty, and it was the opinion of the court that he be tried before the General Court (Creel, Bedford County Virginia Court Orders 1774-1783, 110, with reference to Order Book 6, 296).
